These terms outline the agreement between you (our valued customer) and us regarding the use of our website and the purchase of our products.

We specialise in a wide range of indoor greenery, including:

• Accessories: Indoor Plant Pots, Plants With Pots, Plant Care products, and Plant Food.
• Gifting: Curated plant and accessory bundles.

We strive to represent our products as accurately as possible in photographs and descriptions. However, please note that each living plant is unique, and its exact appearance may vary slightly. Sizes are approximate.

4. Ordering & Payment Terms

4.1. Placing an Order

Adding an item to your cart is an invitation to treat. A contract between us is only formed when we send you an order confirmation email.

4.2. Pricing and Payment

• Prices are listed in British Pounds (£) and include VAT where applicable.
• We accept the following secure payment methods: Visa, MasterCard, JCB, and PayPal.
• Your payment is processed securely at the time of order. We reserve the right to cancel any order if payment authorisation is declined.

4.3. Order Processing & Shipping

• Processing Time: All orders are prepared with care and dispatched from our Liverpool nursery within 1-2 business days.
• Shipping Methods:
  • Standard Shipping (£12.95 flat fee): Via DHL or FedEx. Estimated delivery 10-15 business days after dispatch.
  • Free Shipping: Available on all orders over £50 via EMS. Estimated delivery 15-25 business days after dispatch.
• Delivery Areas: We ship globally but are currently unable to deliver to some restricted regions in Asia and other remote locations. Delivery times are estimates and may be affected by customs or seasonal factors.

Your Responsibility: It is your responsibility to provide a correct and deliverable shipping address. We are not liable for delays or losses due to incorrect addresses provided by you.

5. Returns, Refunds & Exchanges

Our goal is your complete satisfaction. Our policy is designed with transparency and care, mirroring our approach to plant care.

5.1. Key Policy Overview

• Return/Exchange Window: 15 days from the delivery date.
• Condition: Items must be unused, in original packaging, and in resalable condition.

5.2. What Can Be Returned?

We accept returns/exchanges for most items within 15 days, including plants, pots, and unopened care products.

5.3. What Cannot Be Returned?

• Custom or “Final Sale” items.
• Personalised gifts.
• Opened or used Plant Care products (food, soils, treatments).
• Plants with signs of post-delivery care issues (as outlined in section 3).

5.4. The Return Process & Your Obligations

1. Contact Us: Email [email protected] within 15 days of delivery with your order details.
2. Await Authorisation: Do not send items back without a Return Merchandise Authorisation (RMA) number from us.
3. Package Securely: Repack the item in its original packaging, securing plants as they were delivered.
4. Ship to Us: Send the authorised return to our Liverpool nursery using a tracked service. You are responsible for the return shipping costs, unless the return is due to our error (e.g., wrong item sent).

5.5. Refunds

Upon approval of your return, we will issue a refund to your original payment method within 5-10 business days. Original shipping fees are non-refundable.

6. Limitation of Liability

Happy House Plants Sale Store is committed to providing high-quality products and services. However, our liability to you is limited as follows:

• We are not liable for any indirect, incidental, or consequential losses (such as loss of profit or data) arising from your use of our site or products.
• Our total liability for any claim related to an order shall not exceed the total value of that order.
• We are not liable for failures or delays in performance due to events beyond our reasonable control (force majeure), including but not limited to postal/courier strikes, extreme weather, or international customs delays.
• As stated throughout, we are not liable for the health or survival of living plants after they have been delivered and are in your care, as this is dependent on environmental factors beyond our control.

This limitation is fair and reflects the nature of selling living products online.

7. General Provisions

Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Severability: If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
